Terms of Service

Please read these Terms carefully. By creating an account or using MyPelican, you agree to be bound by these Terms of Service.

1. Acceptance of Terms

By accessing or using MyPelican, you confirm that you are at least 18 years of age, are an Australian resident, and have the legal capacity to enter into this agreement. If you do not agree to these Terms, do not use the service.

2. Description of Service

MyPelican is a personal finance application that:

  • Connects to your bank accounts via Open Banking (Consumer Data Right) to retrieve account and transaction data.
  • Provides AI-generated insights and suggestions to help you better understand and manage your finances.
  • Displays your net worth, account balances, and transaction history in one place.

MyPelican is a financial technology tool and is NOT a licensed financial adviser. Nothing in the app constitutes financial advice.

3. Account Registration

You must provide accurate and complete information when creating your account. You are responsible for:

  • Keeping your login credentials secure.
  • All activity that occurs under your account.
  • Notifying us immediately of any unauthorised access at admin@mypelican.com.au.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Open Banking Consent

To use bank-connected features, you must grant consent under the Consumer Data Right framework. By connecting your bank you acknowledge:

  • You authorise MyPelican to access the data types specified at the time of consent.
  • Consent is voluntary and can be withdrawn at any time from within the app.
  • We access your data only to provide the service — we do not sell it.
  • Disconnecting your bank will delete all associated account and transaction data from MyPelican.

5. Prohibited Uses

You agree not to:

  • Use the service for any unlawful purpose or in violation of any Australian law.
  • Attempt to gain unauthorised access to any part of the service or its infrastructure.
  • Reverse engineer, decompile, or disassemble the application.
  • Use the service in a way that could damage, disable, or impair its functionality.
  • Share your account credentials with any third party.

6. Intellectual Property

All content, features, and functionality of MyPelican — including the name, logo, design, code, and text — are owned by MyPelican (ABN 65 983 953 179) and protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

7. Disclaimer of Warranties

MyPelican is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

  • The service will be uninterrupted, error-free, or free of viruses.
  • Financial data displayed is always accurate or up to date (it depends on your bank and the Open Banking infrastructure).
  • AI-generated insights are accurate, complete, or suitable for your circumstances.

8. Limitation of Liability

To the maximum extent permitted by Australian law, MyPelican (ABN 65 983 953 179) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including any financial decisions made based on information provided by the app.

9. Termination

You may delete your account at any time from Settings → Delete account. We may suspend or terminate your access if you breach these Terms, with or without prior notice. Upon termination, your right to use the service ceases immediately.

10. Governing Law

These Terms are governed by the laws of Western Australia, Australia. The operator of MyPelican is Apoorv Kumar trading as MyPelican (ABN 65 983 953 179). Any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use of the service after changes constitutes acceptance of the updated Terms.
